The presentation will focus on statutory and caselaw outlining circumstances under which Company Managers, Supervisors, Officers and Shareholders may be found to be liable for unpaid wages to employees under Federal law (the Fair Labor Standards Act (“FLSA), and under the South Carolina Payment of Wages Act.  This session will explore who is an “employer” and under what circumstances a manager, supervisor, officer, shareholder or similarly situated employee may be held liable for unpaid wages under the Acts.

Emma Ruth Brittain, Thomas & Brittain, P.A., primarily represents private sector, governmental and other public sector entities, and employers in labor and employment law matters, including administrative charges/complaints filed with federal and State agencies (such as the EEOC, SHAC and DOL). Much of her practice is devoted to advising hospitality-related employers, including drafting employment policies, handbooks, contracts, non-competition and confidentiality agreements.  She is a Certified Specialist in Labor and Employment Law, has served on the S.C. Supreme Court’s Specialization Advisory Board for Employment and Labor Law.  She is a  member of the Horry County Bar Association (former President), S.C. Bar Association, and a member of the Coastal Inn of Court.
